Plumber in Morgan Hill, CA: The Sewer Lateral Certificate, Fixture Retrofits and Hard Water

A house about to be listed, an older toilet that keeps running, or a tank that has quit. In Morgan Hill the City decides what has to be inspected and what has to be replaced before a sale.

Selling in Morgan Hill: the lateral inspection comes first

Morgan Hill has a rule that catches sellers off guard. Ordinance 2322, effective June 1, 2022, requires every residential, commercial and industrial building to have its private sewer lateral inspected by a Qualified Contractor, with any needed repairs completed before the property is sold. The City's own wording is that the lateral, the line from the building to the main, is the property owner's responsibility.

The seller and buyer may agree that the buyer makes the repairs. If so, the buyer must finish them no later than 180 calendar days after the sale. Without that agreement, the repair is a closing item, and a late discovery can hold up the date.

Book the video inspection as soon as the house is listed. If the camera finds a defect, sewer line work after a failed inspection explains what the repair involves, and whether lining the pipe is an option.

What to ask the contractor: whether they qualify under the City ordinance, whether you will receive the footage, and whether the compliance certificate will be issued to you.

Exemptions, the certificate and new water service

The ordinance lists exemptions and links the certificate to other events. Read them against your own house before assuming one applies.

SituationWhat the ordinance says
Lateral built or replaced recentlyExempt if it was built or replaced 15 years or less before the sale
Lateral inspected and passedExempt if it passed inspection less than 10 years before the sale
New water service after a saleNeeds a Compliance Certificate for Private Sewer Lateral issued within the past ten years
New building on an existing lateralThe lateral must be inspected as a condition of passing the final building permit inspection

The utility page on property sales repeats the point: the lines from the exterior of the building to the main, including the connection to the City main, belong to the property owner.

Older houses and the plumbing fixture retrofit at sale

A separate City ordinance, Ordinance 2323, requires existing residential buildings to be retrofitted with high-efficiency plumbing fixtures at the time of sale. The City's utility inspections page says it applies to properties built on or before January 1, 1994.

In practice this means a seller of an older house should check the toilets, faucets and showerheads before the sale. A toilet that runs or an old fixture that has to be replaced anyway is easier to deal with early. The page on replacing an older toilet explains what a replacement involves, and faucet and sink fixes before listing covers the faucet side.

Ask the City what documentation it needs after the work, so the paperwork is ready at closing.

Help paying for a lateral repair

The City has a grant program for replacing or repairing a private sewer lateral. It pays a share of the lowest contractor bid, and approval is required before work starts. The City lists a phone number of 669-253-4332 and an email at [email protected] for the program.

Programs change from year to year, and this one was posted for fiscal year 2026-27. Confirm that funds are still open and what the share and cap are before you sign a contract. A repair started before approval may not qualify.

When you collect bids, get each one in writing with the scope described the same way, so the City's lowest-bid test compares like with like.

Morgan Hill in southern Santa Clara County

Morgan Hill lies roughly sixteen miles northeast of Watsonville in a straight line, in southern Santa Clara County. It has its own City utilities and its own building department.

Water heater replacements need a City permit

The City's water heater page says permits are required for all water heater replacements. The Building and Fire Prevention office is at 17575 Peak Avenue, and the phone is 408-778-6480. The City also says a permit is required for any alteration or repair to an existing building or structure.

Ask the installer who applies for the permit and when the inspection happens. Confirm the new tank will be braced, anchored or strapped as California Health and Safety Code 19211 requires.

When a tank is leaking, replacement is the usual answer, and a water heater swap walks through what to settle. When it only stops heating, a tank that will not heat covers the parts that most often fail.

Hand gripping a pipe fitting on a water heater inlet with a clear cup catching drips beneath it.
Disconnecting the inlet is part of a swap, and it is one more reason to settle the permit first.

Hard water: a number from the City's own report

The City of Morgan Hill supplies water from groundwater wells. Its 2025 Consumer Confidence Report lists hardness at an average of 234 milligrams per liter, with samples from 201 to 276, and describes it as an average of 16 grains per gallon.

That is hard water. Scale builds on heating elements and inside tankless units, and it leaves crust on faucets. If you see it, ask the plumber to look inside an old tank when it comes out. The page on treating hard water at the main line explains how to decide between a softener, a filter and doing nothing.

Reporting a sewer spill, and when a plumber is the right call

The City asks residents to report spills through its SeeClickFix maintenance platform. The Utilities Corporation Yard can be reached at 408-776-7333 during business hours.

A backup that stays inside your house is a different matter. If one fixture is slow, the problem is local. If several fixtures gurgle or a floor drain backs up, the blockage is in the lateral or the main, and clearing a blocked main line is the place to start.

Before you call: sale date, buyer and permit papers

Give the street address and say whether a sale or an addition is coming, since both bring the lateral inspection into play. Say whether the buyer has agreed to take over repairs. If a water heater is involved, mention its age and whether it leaks.
